These Terms & Conditions ("Terms") are a contract between you and HMS Ai ("HMS Ai", "we", "us"), the provider of the HMS Ai application and website (the "Service"). By creating an account, purchasing a plan, or continuing to use the Service, you agree to these Terms. If you use the Service on behalf of an organisation, you confirm you have authority to bind it; if you use it as an individual, you confirm you are of legal age in your country.
1. The Service
HMS Ai provides a suite of AI-powered tools — including chat, image generation, writing, translation, summarisation, coding, voice and document tools — offered on free and paid plans. We may add, change or discontinue individual tools and features over time.
2. Your account
- Provide accurate information and keep it up to date.
- Keep your credentials confidential; you are responsible for activity under your account.
- Tell us promptly if you suspect unauthorised access.
3. Licence and restrictions
We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service within the limits of your selected plan. You must not reverse engineer, copy, resell, sublicense or redistribute the Service, circumvent technical or usage limits, or share account access beyond what your plan allows.
4. Acceptable use
You must not use the Service to:
- break any law or regulation, or facilitate illegal activity;
- commit fraud, send spam, phish, or impersonate others;
- infringe intellectual property, privacy or publicity rights;
- interfere with security or integrity — malware, probing, scanning, scraping, denial of service, unauthorised access, or bypassing rate limits and authentication;
- generate or distribute prohibited content, including sexual content involving minors, non consensual sexual or intimate imagery, deceptive deepfakes of real people, hate speech, harassment, incitement to violence, self-harm promotion, malware or exploit code, or content designed to defraud or deceive;
- attempt to jailbreak, prompt-inject or otherwise defeat our safety systems.
5. AI inputs, outputs and responsibility
- You are responsible for the prompts and files you submit, for having the rights to submit them, for how you use the outputs, and for verifying accuracy before relying on them.
- You retain rights in your inputs and, as between you and us, in the outputs you generate, subject to these Terms. You grant us a limited licence to host and process your content solely to operate and support the Service.
- Accuracy disclosure: AI outputs may be inaccurate, incomplete, outdated or offensive, and similar outputs may be generated for other users. Outputs are not professional advice — do not rely on them for medical, legal, financial, safety or other regulated decisions without qualified human review.
- Rights-holder complaints: if you believe content generated or stored through the Service infringes your rights, email contact support with details and we will review and, where appropriate, remove the content. Repeat or serious infringers lose access.
- Moderation: we may filter, refuse, restrict or remove content and suspend accounts to enforce these Terms or applicable law.
6. Intellectual property
HMS Ai and its licensors retain all rights in the Service, including its software, interfaces, documentation, trade marks and branding. Nothing in these Terms transfers ownership of the Service to you.
7. Plans, payments, subscriptions and refunds
Paid plans are sold on monthly, yearly or one-time (lifetime) terms as shown at checkout. Subscriptions renew automatically for the same term until cancelled. Upgrades and downgrades take effect immediately, with pro-rating applied by our payment provider; a cancellation stops future renewals.
HMS Ai offers a 30-day money-back guarantee on paid subscriptions. If you are not satisfied, you may request a full refund within 30 days of your purchase date. See our Refund Policy for full details and eligibility.
Payment, billing, currency, taxes, invoicing, cancellations and other refund mechanics are governed by Paddle's Buyer Terms.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
8. Service level
We work to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free performance. Maintenance, updates, third-party provider outages and factors outside our control may affect availability.
9. Warranties
To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.
10. Liability
To the extent permitted by law, we are not liable for indirect, incidental, consequential or special damages, or for lost profits, revenue, data or goodwill. Our aggregate liability is limited to the fees you paid for the Service in the 12 months before the claim. Nothing excludes liability for fraud, death or personal injury caused by negligence, or any liability that cannot be excluded by law.
11. Indemnity
You will indemnify HMS Ai against third-party claims arising from your content, your unlawful or infringing use of the Service, or your breach of these Terms.
12. Suspension and termination
We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service and close your account at any time. On termination your licence ends; you may request an export of your content within 30 days, after which we may delete it in line with our Privacy Notice.
13. Changes to these Terms
We may update these Terms; material changes will be notified in the app or by email, and continued use after the effective date means you accept the updated Terms.
14. General
You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or reorganisation. Neither party is liable for delays caused by events beyond its reasonable control. These Terms are governed by the laws of Pakistan, and the courts of Pakistan have jurisdiction, without limiting mandatory consumer rights in your country of residence. If a provision is unenforceable, the rest remains in effect.
